The Software (I) shall be used solely and exclusively for the internal use of the User's employee's; and (ii) may be used solely and exclusively in connection with accessing and using the Data.

ALL DATA AVAILABLE THROUGH PROJECTDOG - PROPRIETARY RIGHTS

Permission to use Data consisting and not limited to all Electronic Plans, Specifications, Addendum, Contact Information, and Project Details from this server ('Server') is granted, provided that (1) the aforementioned copyright notice appears in all copies and that both the copyright notice and this permission notice appear, (2) use of such Data from this Server is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and (3) no modifications to any documents are made. (4) No Data shall be distributed to any third party not engaged in contract with Projectdog, Inc. Use for any other purpose is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. Deposit checks shall be made out to Projectdog with a certified check or money order. The full amount of the deposit will be refunded to all responsive bidders returning the Contract Documents in good condition within ten (10) days after date of bid opening. Otherwise, the deposit will become the property of Projectdog. The documents and related graphics published on this server could include technical inaccuracies or typographical errors. Changes are periodically added to the information herein. Information may be changed or updated without notice. It is the responsibility of the end user to verify the accuracy and currency of all project information prior to submitting any bid. VIOLATIONS

Violations of the above terms may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. The End User agrees that violations of the terms of this Agreement will cause Projectdog, Inc substantial harm entitling it to injunctive relief.

MISCELLANEOUS

Neither party shall have any liability for any default resulting from force majeure, which shall be deemed to include circumstances beyond its reasonable control. This Agreement and any other further service agreement or like contract executed by and between the parties shall constitute the entire Agreement between the parties with respect to the subject matter hereof. Failure of Projectdog, Inc to insist upon strict compliance with the terms of this Agreement or to seek remedy for breach thereof shall not constitute or be construed as a waiver of any rights or remedies under the Agreement or of any such breach. This Agreement shall be interpreted and construed in accordance with the internal laws of the Commonwealth of Massachusetts and in the event any legal disputes the parties agree that the Commonwealth of Massachusetts is the sole appropriate forum for resolution of legal disputes. The End User shall not sell, assign, and transfer any license granted hereunder. The posting of this website is not meant as an attempt by Projectdog, Inc to avail itself of the laws and/or benefits of other states. All business transacted on this website shall be considered to have been transacted within the Commonwealth of Massachusetts, the principal place of business of Projectdog, Inc
